  • General

1.1. These general conditions of sale govern the use of the Ashukan 2.0 online store (hereinafter referred to as “Ashukan”) and the sale of the products offered on Ashukan. By accessing Ashukan and placing an order, you agree to be bound by these terms and conditions of sale.

1.2. Ashukan is operated by Les Productions Feux Sacrés (hereinafter referred to as “PFS”), registered in Montreal, Canada.

  • Products and Orders

2.1. Ashukan offers products for sale, including but not limited to handmade artisan products by Canadian Indigenous artists. Product descriptions, images and prices are provided for informational purposes only and may be subject to change without notice.

2.2. To place an order, you must be at least 18 years old and have legal capacity to enter into contracts. By placing an order, you warrant that all information provided is accurate and complete.

2.3. PFS reserves the right to refuse or cancel any order in the event of non-compliance with these general conditions of sale, suspicion of fraud, or for any other legitimate reason. In the event of cancellation, PFS will refund any payment made.

  • Price and Payment

3.1. Product prices are quoted in Canadian dollars (CAD) and do not include applicable taxes, delivery charges and other charges, unless otherwise noted.

3.2. Payment for products is made at the time of ordering. PFS accepts the following payment methods: Visa, American Express, Google Pay, Apple Pay, Paypal and Mastercard.

3.3. All financial transactions are secure and payment information is processed in accordance with applicable data protection laws and regulations.

  • Delivery

4.1. PFS undertakes to deliver the products within the deadlines indicated when ordering. Delivery times may vary depending on destination and product availability.

4.2. Delivery costs are indicated during the ordering process and may vary depending on the destination and weight of the products.

4.3. PFS will not be liable for delays or losses caused by events beyond its control, such as strikes, natural disasters, logistical problems, etc.

  • Intellectual property

6.1. All intellectual property rights relating to Ashukan and the products sold are the property of PFS. Any unauthorized reproduction, modification, distribution or use is strictly prohibited.

  • Protection of personal data

7.1. PFS is committed to respecting the confidentiality and protection of personal data in accordance with its privacy policy, available on Ashukan.

  • Limitation of liability

8.1. PFS will not be liable for any direct, indirect, incidental, special or consequential damages arising from the use of Ashukan or the purchase of the products, except in cases of gross negligence or fraudulent intent.

  • Modification of the general conditions of sale

9.1. PFS reserves the right to modify these general conditions of sale at any time. Changes will be applicable as soon as they are published on Ashukan.

  • Applicable law and competent jurisdiction

10.1. These general conditions of sale are governed by the laws in force in Canada. Any dispute arising from these conditions will be subject to the exclusive jurisdiction of the competent courts of Canada.
